                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the transfer of land from the extraterritorial
 1-3     jurisdiction of one municipality to the extraterritorial
 1-4     jurisdiction of another municipality when the land is also in a
 1-5     municipal utility district.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1.  Subchapter B, Chapter 42, Local Government Code,
 1-8     is amended by adding Section 42.026 to read as follows:
 1-9           Sec. 42.026.  APPROVAL NECESSARY FOR TRANSFER OF
1-10     EXTRATERRITORIAL JURISDICTION LOCATED IN MUNICIPAL UTILITY
1-11     DISTRICT.  The extraterritorial jurisdiction of a municipality does
1-12     not include and may not be  extended to an area that another
1-13     municipality has released from its extraterritorial jurisdiction
1-14     and that is located in a municipal utility district, without the
1-15     approval of the governing body of the municipal utility district.
1-16           SECTION 2.  This Act takes effect September 1, 1999.
1-17           SECTION 3.  The importance of this legislation and the
1-18     crowded condition of the calendars in both houses create an
1-19     emergency and an imperative public necessity that the
1-20     constitutional rule requiring bills to be read on three several
1-21     days in each house be suspended, and this rule is hereby suspended.
