1-1                                   AN ACT
 1-2     relating to the juvenile board in Fisher, Mitchell, and Nolan
 1-3     counties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 152.0821, Human Resources Code, is
 1-6     amended by amending Subsections (a), (b), and (c) and adding
 1-7     Subsections (f) and (g) to read as follows:
 1-8           (a)  Fisher County is included in the Fisher, Mitchell, and
 1-9     Nolan counties juvenile board.  The juvenile board is composed of:
1-10                 (1)  a [the] county judge from [judges and the district
1-11     judges in] Fisher, Mitchell, or [and] Nolan County elected by a
1-12     majority vote of the county judges from those counties;
1-13                 (2)  the 32nd Judicial District judge or the judge of
1-14     the county court at law in Nolan County who is selected by
1-15     agreement between those two judges;
1-16                 (3)  one person [two persons] appointed by the Nolan
1-17     County Commissioners Court;
1-18                 (4)  subject to Subsection (f), the city manager of
1-19     Sweetwater or another person [two persons] appointed by the
1-20     Sweetwater City Commission;
1-21                 (5)  subject to Subsection (g), the superintendent of
1-22     the Sweetwater Independent School District or another person [two
1-23     persons] appointed by the board of trustees of the Sweetwater
1-24     Independent School District;
 2-1                 (6)  one person [three members] appointed by the
 2-2     Mitchell County Commissioners Court; [and]
 2-3                 (7)  one person [two members] appointed by the Fisher
 2-4     County Commissioners Court;
 2-5                 (8)  the county attorney of Fisher, Mitchell, or Nolan
 2-6     County selected by a majority vote of the county judges of those
 2-7     counties; and
 2-8                 (9)  one person selected by majority vote of the county
 2-9     judges of Fisher, Mitchell, and Nolan counties, subject to
2-10     confirmation by a vote of the commissioners courts of each of those
2-11     counties.
2-12           (b)  The chairman of the board is the county judge appointed
2-13     under Subsection (a)(1) [by majority vote shall annually elect one
2-14     of its members as chairman].  The chairman presides at meetings
2-15     scheduled by the board.
2-16           (c)  The appointed members serve without compensation.  Each
2-17     member serves a two-year term.
2-18           (f)  The board member appointed by the Sweetwater City
2-19     Commission under Subsection (a)(4)  may be appointed only if the
2-20     City of Sweetwater agrees to provide funds for the salaries of the
2-21     personnel assigned to Nolan County and other expenses the board
2-22     chairman certifies as necessary to provide adequate juvenile
2-23     services to Nolan County as provided by Section 152.1831(d).
2-24           (g)  The board member appointed by the Sweetwater Independent
2-25     School District under Subsection (a)(5)  may be appointed only if
2-26     that school district agrees to provide funds for the salaries of
2-27     the personnel assigned to Nolan County and other expenses the board
 3-1     chairman certifies as necessary to provide adequate juvenile
 3-2     services to Nolan County as provided by Section 152.1831(d).
 3-3           SECTION 2.  Section 152.1831, Human Resources Code, is
 3-4     amended by amending Subsections (a), (b), and (c), and adding
 3-5     Subsections (f) and (g) to read as follows:
 3-6           (a)  Nolan County is included in the Fisher, Mitchell, and
 3-7     Nolan counties juvenile board.  The juvenile board is composed of:
 3-8                 (1)  a [the] county judge from [judges and the district
 3-9     judges in] Fisher, Mitchell, or [and] Nolan County elected by a
3-10     majority vote of the county judges from those counties;
3-11                 (2)  the 32nd Judicial District judge or the judge of
3-12     the county court at law in Nolan County who is selected by
3-13     agreement between those two judges;
3-14                 (3)  one person [two persons] appointed by the Nolan
3-15     County Commissioners Court;
3-16                 (4)  subject to Subsection (f), the city manager of

3-19                 (5)  subject to Subsection (g), the superintendent of
3-20     the Sweetwater Independent School District or another person [two
3-21     persons] appointed by the board of trustees of the Sweetwater

3-23                 (6)  one person [three members] appointed by the
3-24     Mitchell County Commissioners Court;  [and]
3-25                 (7)  one person [two members] appointed by the Fisher
3-26     County Commissioners Court;
3-27                 (8)  the county attorney of Fisher, Mitchell, or Nolan
 4-1     County selected by a majority vote of the county judges of those
 4-2     counties; and
 4-3                 (9)  one person selected by majority vote of the county
 4-4     judges of Fisher, Mitchell, and Nolan counties, subject to
 4-5     confirmation by a vote of the commissioners courts of each of those
 4-6     counties.
 4-7           (b)  The chairman of the board is the county judge appointed

4-19           (g)  The board member appointed by the Sweetwater Independent
4-20     School District under Subsection (a)(5)  may be appointed only if
4-21     that school district agrees to provide funds for the salaries of
4-22     the personnel assigned to Nolan County and other expenses the board
4-23     chairman certifies as necessary to provide adequate juvenile
4-24     services to Nolan County as provided by Subsection (d).
4-25           SECTION 3.  (a)  This Act takes effect September 1, 1999.
4-26           (b)  The terms of the members of the Juvenile Board of Fisher
4-27     County who are serving immediately before the effective date of
 5-1     this Act expire on that date.  As soon as possible after the
 5-2     effective date of this Act, members of the Juvenile Board of Fisher
 5-3     County shall be appointed in accordance with Section 152.0821,
 5-4     Human Resources Code, as amended by this Act.
 5-5           (c)  The terms of the members of the Juvenile Board of Nolan
 5-6     County who are serving immediately before the effective date of
 5-7     this Act expire on that date.  As soon as possible after the
 5-8     effective date of this Act, members of the Juvenile Board of Nolan
 5-9     County shall be appointed in accordance with Section 152.1831,
5-10     Human Resources Code, as amended by this Act.
5-11           SECTION 4.  The importance of this legislation and the
5-12     crowded condition of the calendars in both houses create an
5-13     emergency and an imperative public necessity that the
5-14     constitutional rule requiring bills to be read on three several
5-15     days in each house be suspended, and this rule is hereby suspended.
