                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the services included in home health care services.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 142.001(12), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6                 (12)  "Home health service" means the provision of one
 1-7     or more of the following health services required by an individual
 1-8     in a residence or independent living environment:
 1-9                       (A)  nursing, including blood pressure monitoring
1-10     and diabetes treatment;
1-11                       (B)  physical, occupational, speech, or
1-12     respiratory therapy;
1-13                       (C)  medical social service;
1-14                       (D)  intravenous therapy;
1-15                       (E)  dialysis;
1-16                       (F)  service provided by unlicensed personnel
1-17     under the delegation of a licensed health professional;
1-18                       (G)  the furnishing of medical equipment and
1-19     supplies, excluding drugs and medicines; or
1-20                       (H)  nutritional counseling.
1-21           SECTION 2.  This Act takes effect September 1, 1999.
1-22           SECTION 3.  The importance of this legislation and the
1-23     crowded condition of the calendars in both houses create an
1-24     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended.
