A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to review of certain children's continued eligibility for
1-3 medical assistance.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1-6 is amended by adding Section 32.0251 to read as follows:
1-7 Sec. 32.0251. ELIGIBILITY REVIEW FOR CERTAIN CHILDREN. (a)
1-8 The department shall establish and implement procedures under which
1-9 the department automatically reviews a child's eligibility for
1-10 medical assistance if:
1-11 (1) the child originally establishes eligibility for
1-12 medical assistance on the basis of receipt of financial assistance
1-13 under Chapter 31, as provided by Section 32.025(a); and
1-14 (2) that receipt of financial assistance under Chapter
1-15 31 ceases.
1-16 (b) The department shall ensure that the child continues to
1-17 receive medical assistance without a gap in eligibility if the
1-18 review required by this section indicates that the child is
1-19 eligible for medical assistance on another basis.
1-20 SECTION 2. The importance of this legislation and the
1-21 crowded condition of the calendars in both houses create an
1-22 emergency and an imperative public necessity that the
1-23 constitutional rule requiring bills to be read on three several
1-24 days in each house be suspended, and this rule is hereby suspended,
1-25 and that this Act take effect and be in force from and after its
2-1 passage, and it is so enacted.
