A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to exempting members of the armed forces from the Texas
1-3 Academic Skills Program.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 51.306(r), Education Code, is amended to
1-6 read as follows:
1-7 (r) This section does not apply to:
1-8 (1) a student who accumulated three or more
1-9 college-level semester credit hours prior to the 1989 fall
1-10 semester;
1-11 (2) a student located outside this state who enrolls
1-12 in a course offered outside this state by an institution of higher
1-13 education;
1-14 (3) a deaf student;
1-15 (4) a student who has graduated with a baccalaureate
1-16 degree from an institution of higher education, an accredited
1-17 private or independent institution of higher education, or an
1-18 accredited out-of-state institution of higher education;
1-19 (5) a student enrolled in a certificate program at a
1-20 community or technical college of one year or less; [or]
1-21 (6) a student who is a citizen of a country other than
1-22 the United States and is not seeking a degree; or
1-23 (7) a student who is serving on active duty as a
1-24 member of the armed forces of the United States.
2-1 SECTION 2. Section 51.3061(g), Education Code, is amended to
2-2 read as follows:
2-3 (g) This section does not apply to a student who is:
2-4 (1) enrolled in a certificate program of one year or
2-5 less; or
2-6 (2) serving on active duty as a member of the armed
2-7 forces of the United States.
2-8 SECTION 3. The change in law made by this Act takes effect
2-9 beginning with the 1999 fall semester.
2-10 SECTION 4. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended,
2-15 and that this Act take effect and be in force from and after its
2-16 passage, and it is so enacted.
