1-1 AN ACT
1-2 relating to the conducting of a driver education course by the
1-3 student's grandparent or stepparent.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 521.205(a), Transportation Code, is
1-6 amended to read as follows:
1-7 (a) The department by rule shall provide for approval of a
1-8 driver education course conducted by the parent, stepparent, [or]
1-9 legal guardian, step-grandparent, or grandparent of a person who is
1-10 required to complete a driver education course to obtain a Class C
1-11 license. The rules must provide that:
1-12 (1) the person conducting the course [parent or
1-13 guardian] be a licensed driver;
1-14 (2) the student driver spend a minimum number of hours
1-15 in:
1-16 (A) classroom instruction; and
1-17 (B) behind-the-wheel instruction;
1-18 (3) the person conducting the course [parent or
1-19 guardian] not be convicted of:
1-20 (A) criminally negligent homicide; or
1-21 (B) driving while intoxicated; and
1-22 (4) the person conducting the course [parent or
1-23 guardian] not be disabled because of mental illness.
1-24 SECTION 2. This Act takes effect September 1, 1999.
2-1 SECTION 3. The importance of this legislation and the
2-2 crowded condition of the calendars in both houses create an
2-3 emergency and an imperative public necessity that the
2-4 constitutional rule requiring bills to be read on three several
2-5 days in each house be suspended, and this rule is hereby suspended.
