                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the expiration dates of hunting and fishing licenses.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 42.0175(a), Parks and Wildlife Code, is
 1-5     amended to read as follows:
 1-6           (a)  A license issued under this chapter, other than a
 1-7     lifetime resident hunting license or a nonresident five-day special
 1-8     hunting license, expires on the first anniversary of the date of
 1-9     issuance [is valid only during the yearly period  for which the
1-10     license is issued without regard to the date on which a license is
1-11     acquired.  Each yearly period begins on September 1 or on another
1-12     date set by the commission and extends through August 31 of the
1-13     next year or another date set by the commission.  A license issued
1-14     under this chapter other than a nonresident five-day special
1-15     hunting license that is issued before September 1 or another date
1-16     set by the commission and does not expire until August 31 of the
1-17     next year or another date set by the commission is valid from the
1-18     date of issuance through August 31 of the following year or another
1-19     date set by the commission.  The commission by rule may set the
1-20     amount of a license fee for a license issued during a transition
1-21     period at an amount lower than prescribed in this chapter and
1-22     provide for a license term for a transition period that is shorter
1-23     or longer than a year].
1-24           SECTION 2.  Section 43.012(d), Parks and Wildlife Code, is
 2-1     amended to read as follows:
 2-2           (d)  A stamp issued under this subchapter expires on the
 2-3     first anniversary of the date of issuance [is valid for hunting
 2-4     only during the  yearly period for which the stamp is issued
 2-5     without regard to the date on which the stamp is acquired.  A
 2-6     yearly period begins on September 1 or another date set by the
 2-7     commission and extends through August 31 of the next year or
 2-8     another date set by the commission.  The commission by rule may set
 2-9     the amount of a stamp fee for a stamp issued during a transition
2-10     period at an amount lower than prescribed in this subchapter and
2-11     provide for a stamp term for a transition period that is shorter or
2-12     longer than a year].
2-13           SECTION 3.  Section 43.201(e), Parks and Wildlife Code, is
2-14     amended to read as follows:
2-15           (e)  A stamp issued under this subchapter expires on the
2-16     first anniversary of the date of issuance [is valid for hunting
2-17     only during the  yearly period for which the stamp is issued
2-18     without regard to the date on which the stamp is acquired.  Each
2-19     yearly period begins on September 1 or another date set by the
2-20     commission and extends through August 31 of the next year or
2-21     another date set by the commission.  The commission by rule may set
2-22     the amount of a stamp fee for a stamp issued during a transition
2-23     period at an amount lower than prescribed in this subchapter and
2-24     provide for a stamp term for a transition period that is shorter or
2-25     longer than a year].
2-26           SECTION 4.  Section 43.252(e), Parks and Wildlife Code, is
2-27     amended to read as follows:
 3-1           (e)  A stamp issued under this subchapter expires on the
 3-2     first anniversary of the date of issuance [is valid for hunting
 3-3     only during the  yearly period for which the stamp is issued
 3-4     without regard to the date on which the stamp is acquired.  Each
 3-5     yearly period begins on September 1 or another date set by the
 3-6     commission and extends through August 31 of the next year or
 3-7     another date set by the commission.  The commission by rule may set
 3-8     the amount for a stamp fee for a stamp issued during a transition
 3-9     period at an amount lower than prescribed in this subchapter and
3-10     provide for a stamp term for a transition period that is shorter or
3-11     longer than a year].
3-12           SECTION 5.  Section 43.303(e), Parks and Wildlife Code, is
3-13     amended to read as follows:
3-14           (e)  A stamp issued under this subchapter expires on the
3-15     first anniversary of the date of issuance [is valid for hunting
3-16     only during the  yearly period for which the stamp is issued
3-17     without regard to the date on which the stamp is acquired.  Each
3-18     yearly period begins on September 1 or another date set by the
3-19     commission and extends through August 31 of the next year or
3-20     another date set by the commission.  The commission by rule may set
3-21     the amount of a stamp fee for a stamp issued during a transition
3-22     period at an amount lower than prescribed in this subchapter and
3-23     provide for a stamp term that is shorter or longer than a year].
3-24           SECTION 6.  Section 43.4035, Parks and Wildlife Code, is
3-25     amended to read as follows:
3-26           Sec. 43.4035.  EXPIRATION OF STAMP.  (a)  Except as provided
3-27     by Subsection (b) [or (c)], a stamp issued under this subchapter
 4-1     expires on the first anniversary of the date of issuance  [is valid
 4-2     for fishing only during the yearly period for which the stamp is
 4-3     issued without regard to the date on which the stamp is acquired.
 4-4     Each yearly period begins on September 1 or another date set by the
 4-5     commission and extends through August 31 of the next year or
 4-6     another date set by the commission.  The commission by rule may set
 4-7     the amount of a stamp fee for a stamp issued during a transition
 4-8     period at an amount lower than prescribed in this subchapter and
 4-9     provide for a stamp term for a transition period that is shorter or
4-10     longer than a year].
4-11           (b)  [A saltwater sportfishing stamp issued before September
4-12     1 or another date set by the commission that does not expire until
4-13     August 31 of the following year or another date set by the
4-14     commission is valid from the date of issuance through August 31 of
4-15     the following year or another date set by the commission.]
4-16           [(c)]  A saltwater sportfishing stamp issued in conjunction
4-17     with a license issued under Section 46.005 or 46.0051 of this code
4-18     expires at the same time the license expires or on the expiration
4-19     date printed on the stamp, whichever is later.
4-20           SECTION 7.    Section 43.508, Parks and Wildlife Code, is
4-21     amended to read as follows:
4-22           Sec. 43.508.  EXPIRATION OF STAMP.  (a)  Except as provided
4-23     by Subsection (b) [or (c)], a stamp issued under this subchapter
4-24     expires on the first anniversary of the date of issuance  [is valid
4-25     for fishing only during the yearly period for which the stamp is
4-26     issued without regard to the date on which the stamp is acquired.
4-27     Each yearly period begins on September 1 or another date set by the
 5-1     commission and extends through August 31 of the next year or
 5-2     another date set by the commission.  The commission by rule may set
 5-3     the amount of a stamp fee for a stamp issued during a transition
 5-4     period at an amount lower than prescribed in this subchapter and
 5-5     provide for a stamp term for a transition period that is shorter or
 5-6     longer than a year].
 5-7           (b)  [A freshwater trout stamp issued before September 1 or
 5-8     another date set by the commission that does not expire until
 5-9     August 31 of the next year or another date set by the commission is
5-10     valid from the date of issuance through August 31 of the next year
5-11     or another date set by the commission.]
5-12           [(c)]  A freshwater trout stamp issued in conjunction with a
5-13     license issued under Section 46.005 or 46.0051 expires at the same
5-14     time the license expires or on the expiration date printed on the
5-15     stamp, whichever is later.
5-16           SECTION 8.  Section 43.582(c), Parks and Wildlife Code, is
5-17     amended to read as follows:
5-18           (c)  A stamp issued under this subchapter expires on the
5-19     first anniversary of the date of issuance [is valid for hunting
5-20     only during the  yearly period for which the stamp is issued
5-21     without regard to the date on which the stamp is acquired.  Each
5-22     yearly period begins on September 1 or another date set by the
5-23     commission and extends through August 31 of the next year or
5-24     another date set by the commission.  The commission by rule may set
5-25     the amount of a stamp fee for a stamp issued during a transition
5-26     period at an amount lower than prescribed in this subchapter and
5-27     provide for a stamp term for a transition period that is shorter or
 6-1     longer than a year].
 6-2           SECTION 9.  Section 46.007, Parks and Wildlife Code, is
 6-3     amended to read as follows:
 6-4           Sec. 46.007. EXPIRATION OF LICENSES AND TAGS.  (a)  Except as
 6-5     provided by Subsections (b), (c), (d), and (e)[, and (f)] of this
 6-6     section, a license required or authorized by this subchapter
 6-7     expires on the first anniversary of the date of issuance [is valid
 6-8     only during the yearly period for which it is issued without regard
 6-9     to the date on which the license is acquired.  Each yearly period
6-10     begins on September 1 or another date set by the commission and
6-11     extends through August 31 of the next year or another date set by
6-12     the commission.  The commission by rule may set the amount of a
6-13     license fee for a license issued during a transition period at an
6-14     amount lower than prescribed in this section and provide for a
6-15     license term for a transition period that is shorter or longer than
6-16     a year].
6-17           (b)  A license issued under Section 46.005 or 46.0051 of this
6-18     code is valid for the number of consecutive days authorized at the
6-19     time of issuance [and does not necessarily expire on August 31 or
6-20     another date set by the commission].
6-21           (c)  A tag [or duplicate tag] required or authorized by this
6-22     subchapter expires on the first anniversary of the date of issuance
6-23     [is valid for a period as established by the commission].
6-24           (d)  A duplicate tag authorized by the commission expires on
6-25     the date of issuance of the original tag [A license issued under
6-26     Section 46.004 of this code that is issued before September 1 or
6-27     another date set by the commission and does not expire until August
 7-1     31 of the following year or another date set by the commission is
 7-2     valid from the date of  issuance through August 31 of the following
 7-3     year or another date set by the commission].
 7-4           [(e)]  A lifetime resident fishing license is valid for the
 7-5     lifetime of the license holder.
 7-6           (e) [(f)]  A duplicate license is valid for the period of
 7-7     validity of the original license only.
 7-8           SECTION 10.  (a)  This Act takes effect September 1, 1999.
 7-9           (b)  The changes in law made by this Act apply only to a
7-10     license, stamp, or tag issued by the Parks and Wildlife Department
7-11     on or after September 1, 1999.  The expiration date of a license,
7-12     stamp, or tag issued before September 1, 1999, is governed by the
7-13     law in effect at the time the license, stamp, or tag was issued,
7-14     and the former law is continued in effect for that purpose.
7-15           SECTION 11.  The importance of this legislation and the
7-16     crowded condition of the calendars in both houses create an
7-17     emergency and an imperative public necessity that the
7-18     constitutional rule requiring bills to be read on three several
7-19     days in each house be suspended, and this rule is hereby suspended.
