                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to dealers of certain farm and industrial equipment.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 19.01, Business & Commerce Code, is
 1-5     amended by amending Subdivision (8) to read as follows:
 1-6                 (8)  "Equipment" means farm tractors, farm implements,
 1-7     utility tractors, industrial tractors, forklifts, material-handling
 1-8     equipment, forestry harvesting equipment, and outdoor power
 1-9     equipment and the attachments to or repair parts for those items.
1-10           SECTION 2.  Section 19.22, Business & Commerce Code, is
1-11     amended to read as follows:
1-12           Sec. 19.22.  COERCED ORDERS, [OR] DELIVERIES, OR REFUSALS TO
1-13     PURCHASE.  (a)  A supplier may not coerce or compel a dealer to
1-14     order or accept delivery of equipment with special features or
1-15     accessories not included in the base list price of the equipment as
1-16     publicly advertised by the supplier unless the special features or
1-17     accessories are safety features or accessories required by the
1-18     supplier or by applicable law.
1-19           (b)  A supplier may not coerce or compel a dealer to refuse
1-20     purchase of equipment manufactured by another equipment
1-21     manufacturer.
1-22           SECTION 3.  This Act takes effect September 1, 1999.
1-23           SECTION 4.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
