                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to exceptions to public school class size limits granted
 1-3     by the commissioner of education.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 25.112(d), Education Code, is amended to
 1-6     read as follows:
 1-7           (d)  On application of a school district, the commissioner
 1-8     may except the district from the limit in Subsection (a) if the
 1-9     commissioner finds the limit works an undue hardship on the
1-10     district.  Under an exception granted under this subsection, a
1-11     district may not enroll more than 24 students in a class.  An
1-12     exception expires at the end of the semester for which it is
1-13     granted, and the commissioner may not grant an exception for more
1-14     than one semester at a time.
1-15           SECTION 2.  This Act applies beginning with the 1999-2000
1-16     school year.
1-17           SECTION 3.  The importance of this legislation and the
1-18     crowded condition of the calendars in both houses create an
1-19     emergency and an imperative public necessity that the
1-20     constitutional rule requiring bills to be read on three several
1-21     days in each house be suspended, and this rule is hereby suspended,
1-22     and that this Act take effect and be in force from and after its
1-23     passage, and it is so enacted.
