                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the organization and selection of officers of school
 1-3     district boards of trustees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 11.061, Education Code, is amended by
 1-6     amending Subsection (c) and adding Subsection (e) to read as
 1-7     follows:
 1-8           (c)  Except as provided by Subsection (e) and Section 11.062,
 1-9     [at the first meeting after each election and  qualification of
1-10     trustees,] the members shall, not more frequently than annually,
1-11     organize by selecting:
1-12                 (1)  a president, who must be a member of the board;
1-13                 (2)  a secretary, who may or may not be a member of the
1-14     board; and
1-15                 (3)  other officers and committees the board considers
1-16     necessary.
1-17           (e)  Trustees may at any time select a trustee to serve as an
1-18     officer if that office becomes vacant.  Trustees may also at any
1-19     time select any committees the trustees consider necessary.
1-20           SECTION 2.  This Act takes effect September 1, 1999.
1-21           SECTION 3.  Section 11.061(c), Education Code, as amended by
1-22     this Act, does not prohibit a board of trustees from organizing and
1-23     electing new officers on or after the effective date of this Act,
1-24     regardless of the date on which the trustees previously selected
 2-1     officers.  On the first date on or after the effective date of this
 2-2     Act that trustees select officers, the trustees become subject to
 2-3     Section 11.061(c), Education Code, as amended by this Act, and may
 2-4     not select new officers until one year has elapsed, except as
 2-5     provided by Section 11.061(e), Education Code, as amended by this
 2-6     Act.
 2-7           SECTION 4.  The importance of this legislation and the
 2-8     crowded condition of the calendars in both houses create an
 2-9     emergency and an imperative public necessity that the
2-10     constitutional rule requiring bills to be read on three several
2-11     days in each house be suspended, and this rule is hereby suspended.
