                                A BILL TO BE ENTITLED
 1-1 AN ACT
1-2 relating to providing a parent with a copy of a special education
1-3 student's education plan translated into the parent's native
 1-4 language.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 29.005, Education Code, is amended by
1-7 adding Subsection (d) to read as follows:
1-8 (d) If the child's parent is unable to read English, the
1-9 district shall provide the parent with a copy of the child's
1-10 individualized education program translated into the parent's
1-11 native language, if a community volunteer is available. If the
1-12 district provides documentation of a good-faith effort to provide
1-13 the parent with a written translation of the child's individualized
1-14 education program and documentation that a written translation is
1-15 not feasible, the district may provide the parent with an
1-16 audiotaped translation of the individualized education program made
1-17 during the course of the ARD meeting.
1-18 SECTION 2. The importance of this legislation and the
1-19 crowded condition of the calendars in both houses create an
1-20 emergency and an imperative public necessity that the
1-21 constitutional rule requiring bills to be read on three several
1-22 days in each house be suspended, and this rule is hereby suspended,
1-23 and that this Act take effect and be in force from and after its
1-24 passage, and it is so enacted.
