By Luna H.B. No. 1275 Substitute the following for H.B. No. 1275: By Oliveira C.S.H.B. No. 1275 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to providing a parent with a copy of a special education 1-3 student's education plan translated into the parents native 1-4 language. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 29.005, Education Code, is amended by 1-7 adding Subsection (d) to read as follows: 1-8 (d) If the child's parent is unable to read English, the 1-9 district shall provide the parent with a copy of the child's 1-10 individualized education program translated into the parent's 1-11 native language. If the district provides documentation of a good 1-12 faith effort to provide the parent with a written translation of 1-13 the child's individualized education program and documentation that 1-14 a written translation is not feasible, the district may provide the 1-15 parent with an audiotaped translation of the individualized 1-16 education program made during the course of the ARD meeting. 1-17 SECTION 2. The importance of this legislation and the 1-18 crowded condition of the calendars in both houses create an 1-19 emergency and an imperative public necessity that the 1-20 constitutional rule requiring bills to be read on three several 1-21 days in each house be suspended, and this rule is hereby suspended, 1-22 and that this Act take effect and be in force from and after its 1-23 passage, and it is so enacted.
