1-1                                   AN ACT
 1-2     relating to the regulation of gas utilities organized as limited
 1-3     liability companies.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 101.003(10), Utilities Code, is amended
 1-6     to read as follows:
 1-7                 (10)  "Person" includes an individual, a partnership of
 1-8     two or more persons having a joint or common interest, a mutual or
 1-9     cooperative association, a limited liability company, and a
1-10     corporation.
1-11           SECTION 2.  Section 121.001(b), Utilities Code, is amended to
1-12     read as follows:
1-13           (b)  In this subchapter, "person" means an individual,
1-14     company, limited liability company, or private corporation and
1-15     includes a lessee, trustee, or receiver of an individual, company,
1-16     limited liability company, or private corporation.
1-17           SECTION 3.  Section 181.001(1), Utilities Code, is amended to
1-18     read as follows:
1-19                 (1)  "Corporation" includes:
1-20                       (A)  a partnership or other combination
1-21     [partnerships and other combinations] composed exclusively of
1-22     corporations or in which a corporation is a general partner; and
1-23                       (B)  a limited liability company.
1-24           SECTION 4.  The legislature intends that each change in law
 2-1     made by this Act shall be:
 2-2                 (1)  considered as a clarification of existing law; and
 2-3                 (2)  construed as consistent with the law as it existed
 2-4     immediately before the effective date of this Act.
 2-5           SECTION 5.  The importance of this legislation and the
 2-6     crowded condition of the calendars in both houses create an
 2-7     emergency and an imperative public necessity that the
 2-8     constitutional rule requiring bills to be read on three several
 2-9     days in each house be suspended, and this rule is hereby suspended,
2-10     and that this Act take effect and be in force from and after its
2-11     passage, and it is so enacted.
