1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the single certification of a water or sewer utility in
1-9 an area incorporated or annexed by a municipality.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 13.255(j), Water Code, is amended to read
1-12 as follows:
1-13 (j) This section shall apply only in a case where:
1-14 (1) the retail public utility that is authorized to
1-15 serve in the certificated area that is annexed or incorporated by
1-16 the municipality is a nonprofit water supply or sewer service
1-17 corporation, [or] a special utility district under Chapter 65,
1-18 Water Code, or a fresh water supply district under Chapter 53,
1-19 Water Code; or
1-20 (2) the retail public utility that is authorized to
1-21 serve in the certificated area that is annexed or incorporated by
1-22 the municipality is a retail public utility, other than a nonprofit
1-23 water supply or sewer service corporation, and whose service area
1-24 is located entirely within the boundaries of a municipality with a
1-25 population of 1.7 million or more according to the most recent
1-26 federal census.
1-27 SECTION 2. The importance of this legislation and the
1-28 crowded condition of the calendars in both houses create an
1-29 emergency and an imperative public necessity that the
1-30 constitutional rule requiring bills to be read on three several
1-31 days in each house be suspended, and this rule is hereby suspended,
1-32 and that this Act take effect and be in force from and after its
1-33 passage, and it is so enacted.
