No. 1296 76R5081 JD-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to prohibiting the Texas Department of Public Safety from 1-3 selling a photograph of a person taken in connection with the 1-4 issuance of a driver's license, commercial driver's license, or 1-5 personal identification certificate. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Subchapter C, Chapter 521, Transportation Code, 1-8 is amended by adding Section 521.0505 to read as follows: 1-9 Sec. 521.0505. SALE OF PHOTOGRAPHS; COPYING UNDER PUBLIC 1-10 INFORMATION LAW. The department may not sell a photograph or a 1-11 duplicate of a photograph taken of a person by the department in 1-12 connection with the issuance of a driver's license or a personal 1-13 identification certificate to the person unless the person depicted 1-14 in the photograph consents to the sale. 1-15 SECTION 2. Subchapter C, Chapter 522, Transportation Code, 1-16 is amended by adding Section 522.033 to read as follows: 1-17 Sec. 522.033. SALE OF PHOTOGRAPHS. The department may not 1-18 sell a photograph or a duplicate of a photograph taken of a person 1-19 by the department in connection with the issuance of a commercial 1-20 driver's license to the person unless the person depicted in the 1-21 photograph consents to the sale. 1-22 SECTION 3. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended, 2-3 and that this Act take effect and be in force from and after its 2-4 passage, and it is so enacted.
