 1-7     COMMITTEE AMENDMENT NO. 1                                By:  Lucio
 1-8           Amend H.B. 1303 in Section 2A of the bill (Engrossed Version
 1-9     page 1, line 33) by adding the following subsection:
1-10           (c)  This section does not authorize the District to install,
1-11     operate or maintain street lighting on right-of-way that is part of
1-12     the designated state highway system.
1-13                            A BILL TO BE ENTITLED
1-14                                   AN ACT
1-15     relating to the authority of the San Leon Municipal Utility
1-16     District of Galveston County to install and assess for street
1-17     lighting.
1-18           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-19           SECTION 1.  Chapter 520, Acts of the 59th Legislature,
1-20     Regular Session, 1965 (Article 8280-308, Vernon's Texas Civil
1-21     Statutes), is amended by adding Section 2A to read as follows:
1-22           Sec. 2A.  (a)  If the actions are approved by a majority of
1-23     the voters of the District voting at an election called and held
1-24     for that purpose, the District may:
1-25                 (1)  install, operate, and maintain street lighting
1-26     within a public utility easement or public right-of-way inside the
1-27     District's boundaries; and
1-28                 (2)  assess the cost of installing, operating, and
1-29     maintaining the street lighting as an additional charge in the
1-30     monthly billings of the District's customers.
1-31           (b)  The District may not use money from taxes or bonds
1-32     supported by taxes for a purpose described by this section.
1-33           SECTION 2.  This Act takes effect September 1, 1999.
1-34           SECTION 3.  The importance of this legislation and the
1-35     crowded condition of the calendars in both houses create an
1-36     emergency and an imperative public necessity that the
1-37     constitutional rule requiring bills to be read on three several
1-38     days in each house be suspended, and this rule is hereby suspended.
