A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the delivery of protective orders to certain affected
1-3 persons.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 85.042, Family Code, is amended by
1-6 amending Subsection (d) and adding Subsection (e) to read as
1-7 follows:
1-8 (d) The applicant or the applicant's attorney shall provide
1-9 to the clerk of the court:
1-10 (1) the name, facsimile number, if any, electronic
1-11 mail address, if any, and mailing address of each law enforcement
1-12 agency, child-care facility, and school to which the clerk is
1-13 required to send [mail] a copy of the order under this section; and
1-14 (2) any other information required under Section
1-15 411.042(b)(5), Government Code.
1-16 (e) A copy of an order sent under Subsection (a) or (b) may
1-17 be sent by mail, facsimile transmission, or electronic mail. A
1-18 copy sent by electronic mail complies with the requirements of
1-19 Subsection (a) or (b) if the copy is a substantial copy and the
1-20 electronic mail contains language describing the transmission as a
1-21 substantial copy.
1-22 SECTION 2. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended,
2-3 and that this Act take effect and be in force from and after its
2-4 passage, and it is so enacted.
