A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to regulation of the location of certain alcohol-related
1-3 businesses.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 109.57(d), Alcoholic Beverage Code, is
1-6 amended to read as follows:
1-7 (d) This code [section] does not affect the authority of:
1-8 (1) a governmental entity to regulate, in a manner as
1-9 otherwise permitted by law, the location of:
1-10 (A) [(1)] a massage parlor, nude modeling
1-11 studio, or other sexually oriented business; or
1-12 (B) [(2)] an establishment that derives 75
1-13 percent or more of the establishment's gross revenue from the
1-14 on-premise sale of alcoholic beverages; or
1-15 (2) a home-rule municipality to regulate the location
1-16 of an establishment that derives 75 percent or more of the
1-17 establishment's gross revenue from the sale of alcoholic beverages
1-18 for off-premise consumption.
1-19 SECTION 2. This Act takes effect September 1, 1999.
1-20 SECTION 3. The importance of this legislation and the
1-21 crowded condition of the calendars in both houses create an
1-22 emergency and an imperative public necessity that the
1-23 constitutional rule requiring bills to be read on three several
1-24 days in each house be suspended, and this rule is hereby suspended.
