                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the sale of land by a municipality to organizations
 1-3     providing housing for low-income families and individuals.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 34.015(a), Tax Code, is amended to read
 1-6     as follows:
 1-7           (a)  Notwithstanding any other provision of this subchapter,
 1-8     the governing body of a municipality may provide for the manner in
 1-9     which any land acquired by the municipality [following the
1-10     foreclosure of a tax lien in favor of the municipality] may be sold
1-11     if the land is sold to:
1-12                 (1)  a nonprofit organization that develops housing for
1-13     low income individuals and families as a primary activity to
1-14     promote community-based revitalization of the municipality; or
1-15                 (2)  a nonprofit corporation described by 26 U.S.C.
1-16     Section 501(c)(3) that:
1-17                       (A)  has been incorporated in this state for at
1-18     least one year;
1-19                       (B)  has a corporate purpose to develop
1-20     affordable housing that is stated in its articles of incorporation,
1-21     bylaws, or charter;
1-22                       (C)  has at least one-fourth of its board of
1-23     directors residing in the municipality; and
1-24                       (D)  engages primarily in the building, repair,
 2-1     rental, or sale of housing for low income individuals and families.
 2-2           SECTION 2.  The importance of this legislation and the
 2-3     crowded condition of the calendars in both houses create an
 2-4     emergency and an imperative public necessity that the
 2-5     constitutional rule requiring bills to be read on three several
 2-6     days in each house be suspended, and this rule is hereby suspended,
 2-7     and that this Act take effect and be in force from and after its
 2-8     passage, and it is so enacted.
