                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to interest earned by the state on child support payments.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter A, Chapter 154, Family Code, is
 1-5     amended by adding Section 154.0035, to read as follows:
 1-6           Sec. 54.0035.  INTEREST ON SUPPORT PAYMENTS.  The Title IV-D
 1-7     agency shall forward to an obligee any interest earned by the Title
 1-8     IV-D agency on a child support payment made to the agency for the
 1-9     obligee.
1-10           SECTION 2.  This Act takes effect September 1, 1999, and
1-11     applies to any child support payment received by the Title IV-D
1-12     agency on or after that date.  A child support payment received by
1-13     the Title IV-D agency before the effective date of this Act is
1-14     governed by the law in effect at the time the payment was received,
1-15     and the former law is continued in effect for that purpose.
1-16           SECTION 3.  The importance of this legislation and the
1-17     crowded condition of the calendars in both houses create an
1-18     emergency and an imperative public necessity that the
1-19     constitutional rule requiring bills to be read on three several
1-20     days in each house be suspended, and this rule is hereby suspended.
