                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the provision of water or sewer service by a
 1-3     municipality outside the territory of the municipality.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 402.001, Local Government Code, is
 1-6     amended by adding Subsection (e) to read as follows:
 1-7           (e)  If a municipality provides water or sewer services
 1-8     outside its municipal boundaries to one or more non-residents it is
 1-9     not required to provide such service to other non-residents.  This
1-10     subsection does not affect the municipality's obligation to provide
1-11     water under a certificate issued under Subchapter G, Chapter 13,
1-12     Water Code, or authorize the municipality to provide service to an
1-13     area over which another provider holds a certificate to provide
1-14     service under that subchapter.
1-15           SECTION 2.  This Act takes effect September 1, 1999.
1-16           SECTION 3.  The importance of this legislation and the
1-17     crowded condition of the calendars in both houses create an
1-18     emergency and an imperative public necessity that the
1-19     constitutional rule requiring bills to be read on three several
1-20     days in each house be suspended, and this rule is hereby suspended.
