A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the Henderson County Juvenile Board.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 152.1131, Human Resources Code, is
1-5 amended to read as follows:
1-6 Sec. 152.1131. HENDERSON COUNTY. (a) The juvenile board of
1-7 Henderson County is composed of:
1-8 (1) the county judge;
1-9 (2) the judges of the 3rd, [and] 173rd, and 392nd
1-10 judicial districts;
1-11 (3) the judge of the county court at law; and
1-12 (4) the county attorney.
1-13 (b) The juvenile board shall elect one of its members as
1-14 chairman at its first regular meeting of each fiscal year. [The
1-15 judge of the 173rd Judicial District is the chairman of the board
1-16 and its chief administrative officer.][]
1-17 (c) The commissioners court shall pay the 173rd and 392nd
1-18 district judges and the county court at law [juvenile court] judge
1-19 an amount set by the commissioners court at not less than $750 a
1-20 month and shall pay the 3rd district judge an amount set by the
1-21 commissioners court at not less than one-third of the amount paid
1-22 to the 173rd or 392nd district judge or the county court at law
1-23 [for the added duties imposed on the] judge. The commissioners
1-24 court shall pay the other juvenile board members an amount set by
2-1 the commissioners court at not less than $250 a month [for the
2-2 added duties imposed on the members]. The compensation is in
2-3 addition to other compensation provided or allowed by law [for a
2-4 county attorney].
2-5 (d) The county attorney shall file, prosecute, and try on
2-6 behalf of the state all juvenile cases in the juvenile court. A
2-7 [The] district attorney with jurisdiction in Henderson County [for
2-8 the 173rd Judicial District] shall act for the county attorney at
2-9 the request of the juvenile court judge if the county attorney is
2-10 ill or unable to perform his duties.
2-11 (e) [The 173rd District Court is designated the juvenile
2-12 court of Henderson County.]
2-13 [(f)] Sections 152.0002, 152.0004, 152.0005, 152.0006,
2-14 152.0007, and 152.0008(a) do not apply to the juvenile board of
2-15 Henderson County.
2-16 SECTION 2. This Act takes effect September 1, 1999.
2-17 SECTION 3. The importance of this legislation and the
2-18 crowded condition of the calendars in both houses create an
2-19 emergency and an imperative public necessity that the
2-20 constitutional rule requiring bills to be read on three several
2-21 days in each house be suspended, and this rule is hereby suspended.
