No. 1542 By: Nelson 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to purchasing requirements for school districts and junior 1-11 college districts. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Subchapter A, Chapter 130, Education Code, is 1-14 amended by adding Section 130.010 to read as follows: 1-15 Sec. 130.010. PURCHASING CONTRACTS. (a) The provisions of 1-16 Subchapter B, Chapter 44, relating to the purchase of goods and 1-17 services under contract by a school district apply to the purchase 1-18 of goods and services under contract by a junior college district. 1-19 (b) To the extent of any conflict, the provisions of 1-20 Subchapter B, Chapter 44, prevail over any other law relating to 1-21 the purchase of goods and services by a junior college district. 1-22 SECTION 2. Subchapter B, Chapter 271, Local Government Code, 1-23 is amended by adding Section 271.023 to read as follows: 1-24 Sec. 271.023. CONFLICT OF LAWS. To the extent of any 1-25 conflict, the provisions of Subchapter B, Chapter 44, Education 1-26 Code, relating to the purchase of goods and services under contract 1-27 by a school district prevail over this subchapter. 1-28 SECTION 3. The importance of this legislation and the 1-29 crowded condition of the calendars in both houses create an 1-30 emergency and an imperative public necessity that the 1-31 constitutional rule requiring bills to be read on three several 1-32 days in each house be suspended, and this rule is hereby suspended, 1-33 and that this Act take effect and be in force from and after its 1-34 passage, and it is so enacted. 1-35 * * * * *
