No. 1574 76R3893 MXM-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the permitting of discharges from certain on-site 1-3 sewage disposal systems in certain counties. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended 1-6 by adding Section 26.050 to read as follows: 1-7 Sec. 26.050. ON-SITE SEWAGE DISPOSAL SYSTEM. (a) To the 1-8 extent not in conflict with federal law, the commission by rule 1-9 shall authorize the issuance of a permit, under less stringent 1-10 standards, for the discharge of sewage into or adjacent to water in 1-11 this state by an on-site sewage disposal system if: 1-12 (1) the system is in a county with a population of 1-13 2.8 million or more that is an authorized agent under Chapter 366, 1-14 Health and Safety Code; 1-15 (2) the system is on a property that was subdivided 1-16 and developed before January 1, 1979; 1-17 (3) a county order or resolution has authorized the 1-18 discharge; and 1-19 (4) the commission has approved the county order or 1-20 resolution authorizing the discharge. 1-21 (b) For purposes of this section, "on-site sewage disposal 1-22 system" has the meaning assigned by Section 366.002, Health and 1-23 Safety Code. 1-24 SECTION 2. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended, 2-5 and that this Act take effect and be in force from and after its 2-6 passage, and it is so enacted.
