76R13299 DRH-D By Maxey H.B. No. 1575 Substitute the following for H.B. No. 1575: By Edwards C.S.H.B. No. 1575 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to double parking in a central business district. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 545.302, Transportation Code, is amended 1-5 by adding Subsection (g) to read as follows: 1-6 (g) If the governing body of a municipality determines that 1-7 it is necessary to improve the economic development of the 1-8 municipality's central business district and that it will not 1-9 adversely affect public safety, the governing body may adopt an 1-10 ordinance regulating the standing, stopping, or parking of a 1-11 vehicle at a place described by Subsection (a)(1), other than a 1-12 road or highway in the state highway system, in the central 1-13 business district of the municipality as defined in the ordinance. 1-14 To the extent of any conflict between the ordinance and Subsection 1-15 (a)(1), the ordinance controls. 1-16 SECTION 2. Section 545.303, Transportation Code, is amended 1-17 by adding Subsection (e) to read as follows: 1-18 (e) To the extent of any conflict between Subsection (a) or 1-19 (b) and a municipal ordinance adopted under Section 545.302(g), the 1-20 ordinance controls. 1-21 SECTION 3. The importance of this legislation and the 1-22 crowded condition of the calendars in both houses create an 1-23 emergency and an imperative public necessity that the 1-24 constitutional rule requiring bills to be read on three several 2-1 days in each house be suspended, and this rule is hereby suspended, 2-2 and that this Act take effect and be in force from and after its 2-3 passage, and it is so enacted.
