1-1                                   AN ACT
 1-2     relating to the creation of library districts.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 326.004(a), Local Government Code, is
 1-5     amended to read as follows:
 1-6           (a)  A library district may be created [in a county with a
 1-7     population of more than 100,000] and[, if created,] must be
 1-8     maintained, operated, and financed as provided by this chapter.
 1-9           SECTION 2.  Sections 326.022(a) and (c), Local Government
1-10     Code, are amended to read as follows:
1-11           (a)  A district may include any contiguous territory within a
1-12     single county [that, on the date on which an election is ordered on
1-13     the question of  creating the district, is not in a municipality
1-14     that operates a municipal public library].
1-15           (c)  If the boundaries of the proposed district include any
1-16     territory that, on the date on which an election is ordered on the
1-17     question of creating the district, is part of a municipality that
1-18     operated a municipal public library, then the governing authority
1-19     of that municipality must consent by resolution to allow the
1-20     inclusion of that municipal territory in the proposed district [A
1-21     district may not include territory in more than one county].
1-22           SECTION 3.  This Act takes effect September 1, 1999.
1-23           SECTION 4.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
