                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the preservation and management of Texas music and film
 1-3     artifacts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 441, Government Code, is amended by
 1-6     adding Subchapter K to read as follows:
 1-7                SUBCHAPTER K.  PRESERVATION AND MANAGEMENT OF
 1-8                       STATE MUSIC AND FILM ARTIFACTS
 1-9           Sec. 441.171.  DEFINITIONS.  In this subchapter:
1-10                 (1)  "Commission" means the Texas State Library and
1-11     Archives Commission.
1-12                 (2)  "Music and film artifact" means an item related to
1-13     music or film that has enduring historical or artistic value to the
1-14     state.  The term includes an original motion picture print or early
1-15     musical recording by a person connected with Texas that is in the
1-16     possession of the state, an individual, a private institution,
1-17     another state, or another nation.
1-18                 (3)  "State agency" means:
1-19                       (A)  a department, commission, board, office, or
1-20     other agency in the executive, legislative, or judicial branch of
1-21     state government;
1-22                       (B)  an institution of higher education as
1-23     defined by Section 61.003, Education Code; or
1-24                       (C)  a public nonprofit corporation created by
 2-1     the legislature whose responsibilities and authority are not
 2-2     limited to a geographical area less than that of the state.
 2-3           Sec. 441.172.  DUTIES.  (a)  The commission shall:
 2-4                 (1)  collect and preserve music and film artifacts;
 2-5                 (2)  establish a permanent collection to preserve and
 2-6     display the collected music and film artifacts; and
 2-7                 (3)  maintain a list of music and film artifacts kept
 2-8     by a state agency, including a description of and the name of the
 2-9     depository of each item.
2-10           (b)  The commission may accept a donation of a music or film
2-11     artifact from a state agency, political subdivision, or other
2-12     entity.
2-13           (c)  The commission may cooperate with private entities in
2-14     accomplishing the purposes of this subchapter.
2-15           Sec. 441.173.  PROTECTION, MAINTENANCE, AND STORAGE; RULES.
2-16     The commission may adopt rules establishing standards and
2-17     procedures for the protection, maintenance, and storage of music
2-18     and film artifacts.
2-19           Sec. 441.174.  COOPERATION BY OTHER STATE AGENCIES OR
2-20     POLITICAL SUBDIVISIONS.  (a)  A state agency or political
2-21     subdivision of this state shall cooperate with the commission to
2-22     implement the purposes of this subchapter.
2-23           (b)  The commission shall enter into a memorandum of
2-24     understanding with each state agency or political subdivision
2-25     cooperating with the commission under Subsection (a).
2-26           (c)  The commission shall provide each memorandum of
2-27     understanding to the secretary of state for publication in the
 3-1     Texas Register.
 3-2           SECTION 2.  This Act takes effect September 1, 1999.
 3-3           SECTION 3.  The importance of this legislation and the
 3-4     crowded condition of the calendars in both houses create an
 3-5     emergency and an imperative public necessity that the
 3-6     constitutional rule requiring bills to be read on three several
 3-7     days in each house be suspended, and this rule is hereby suspended.
