 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the construction and rehabilitation of bridges.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Subchapter J, Chapter 201, Transportation Code,
1-11     is amended by adding Section 201.804 to read as follows:
1-12           Sec. 201.804.  SUBMISSION OF BRIDGE DESIGN PLANS TO
1-13     DEPARTMENT.  (a)  This section applies to any governmental entity
1-14     of this state that is  authorized by law to construct or maintain a
1-15     public road and that:
1-16                 (1)  constructs or rehabilitates a bridge;
1-17                 (2)  proposes to assume responsibility for a bridge
1-18     constructed or rehabilitated by another person; or
1-19                 (3)  issues a permit for the construction or
1-20     rehabilitation of a bridge by another person.
1-21           (b)  Before the 31st day after the date the construction or
1-22     rehabilitation of the bridge is completed, the governmental entity
1-23     shall submit to the department a copy of the final structural
1-24     design plans for the bridge.
1-25           (c)  The department shall use information submitted under
1-26     Subsection (b) as necessary in seeking to comply with 23 C.F.R.
1-27     Part 650, Subpart C.
1-28           SECTION 2.  The importance of this legislation and the
1-29     crowded condition of the calendars in both houses create an
1-30     emergency and an imperative public necessity that the
1-31     constitutional rule requiring bills to be read on three several
1-32     days in each house be suspended, and this rule is hereby suspended,
1-33     and that this Act take effect and be in force from and after its
1-34     passage, and it is so enacted.
