                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the transfer by the General Land Office to the City of
 1-3     Texas City the state's interest in certain real property.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  (a)  The commissioner of the General Land Office
 1-6     on behalf of the state may transfer to the City of Texas City the
 1-7     right, title, and interest in and to the property described by
 1-8     Subsection (g) of this section.
 1-9           (b)  The transfer authorized by Subsection (a)  of this
1-10     section must be:
1-11                 (1)  for a cash consideration in an amount not less
1-12     than the fair market value of the property as determined by the
1-13     commissioner of the General Land Office after an appraisal
1-14     performed by an appraiser employed by the General Land Office; and
1-15                 (2)  under other terms negotiated in a purchase and
1-16     sale agreement between the parties.
1-17           (c)  The state expressly reserves for the benefit of the
1-18     permanent school fund the property interest in the minerals in or
1-19     on the property, including the right to explore and develop the
1-20     property for the production of minerals.
1-21           (d)  If, after the transfer authorized by Subsection (a) of
1-22     this section, the City of Texas City transfers or attempts to
1-23     transfer title to all or part of the property, title to the
1-24     property automatically reverts to the state.
 2-1           (e)  On payment of the consideration required by Subsection
 2-2     (b) of this section and the execution of an appropriate instrument
 2-3     of transfer, the title of the City of Texas City to the property
 2-4     becomes absolute, subject only to the reservations provided by this
 2-5     section.  The City of Texas City may use, develop, or lease all or
 2-6     part of the property for public or private purposes subject only to
 2-7     applicable provisions of the Texas Constitution.
 2-8           (f)  Section 31.158, Natural Resources Code, does not apply
 2-9     to the transfer of property authorized by this section.
2-10           (g)  The real property to which Subsection (a) of this
2-11     section refers is described as follows:
2-12                 (1)  Tract 1 is 561.29 acres being part of and out of
2-13     "Snake Island, and adjacent submerged lands of Galveston Bay, S.F.
2-14     14149, in Galveston County, Texas; said 561.29 acres being more
2-15     particularly described by metes and bounds as follows, with all
2-16     bearing referenced to the Texas Coordinate System, South Central
2-17     Zone:
2-18           BEGINNING at the point of intersection of the southerly line
2-19     of the Texas City Channel (400 foot wide at this point) with the
2-20     easterly line of the City of Texas City called 375.75 Acre Tract as
2-21     described in conveyance from the State of Texas to the City of
2-22     Texas as per instrument recorded in Volume 1941, Page 750 of the
2-23     Galveston County Deed Records, said beginning point having
2-24     coordinates of X = 3,312,521.4507, Y = 585,317.1428 and being
2-25     witnessed by found US Corps of Engineers (COE) Monument #4-3 with
2-26     coordinates of X = 3,307,552.6629 and Y = 587,685.0209 at a course
2-27     and distance reference of S 64 deg. 31' 11" E, at 5,504.15 feet;
 3-1           THENCE, S 76 deg. 47' 18" E, along the southerly line of the
 3-2     Texas City Channel (400 feet wide), for a distance of 5,248.23 feet
 3-3     to a point for corner;
 3-4           THENCE, S 13 deg. 12' 42" W, for a distance of 2,900.00 feet
 3-5     to a point for corner;
 3-6           THENCE, S 60 deg. 01' 26" W, for a distance of 6,879.77 feet
 3-7     to a point for corner, on an easterly line of the said City of
 3-8     Texas City called 375.75 Acre Tract;
 3-9           THENCE, N 02 deg. 24' 28" W, along the easterly line of the
3-10     said City of Texas City called 375.75 Acre Tract, at a distance of
3-11     169.67 feet pass a 5/8-inch iron rod set for reference with
3-12     coordinates of X = 3,311,001.3697 and Y = 578,026.5441, and
3-13     continuing for a total distance of 2,166.62 feet to a re-entrant
3-14     corner of said called 375.75 Acre Tract;
3-15           THENCE, N 87 deg. 35' 32" E, along a southerly line of said
3-16     City of Texas City called 375.75 Acre Tract, for a distance of
3-17     1,825.01 feet to a point for corner, same being the most easterly
3-18     Southeast corner of said called 375.75 Acre Tract;
3-19           THENCE, N 02 deg. 24' 28" W, along the easterly line of said
3-20     City of Texas City called 375.75 Acre Tract, at a distance of
3-21     4,193.06 feet pass a 5/8-inch iron rod set for reference with
3-22     coordinates of X = 3,312,564.7326 and Y = 584,287.7551, and
3-23     continuing for a total distance of 5,223.36 feet to the POINT OF
3-24     BEGINNING, of a tract containing 561.29 acres.
3-25                 (2)  Tract 2 is 49.55 acres being part of and out of
3-26     "Snake Island, and adjacent submerged lands of Galveston Bay, S.F.
3-27     14149, in Galveston County, Texas; said 49.55 acres being more
 4-1     particularly described by metes and bounds as follows, with all
 4-2     bearing referenced to the Texas Coordinate System, South Central
 4-3     Zone:
 4-4           BEGINNING at the point of intersection of the southerly line
 4-5     of a 650 foot wide Industrial Canal as indicated on US Corps of
 4-6     Engineers (COE) location map date June, 1978 (File 308-) with the
 4-7     westerly line of the City of Texas City called 375.75 Acre Tract as
 4-8     described in conveyance from the State of Texas to the City of
 4-9     Texas as per instrument recorded in Volume 1941, Page 750 of the
4-10     Galveston County Deed Records, said beginning point having
4-11     coordinates of X = 3,310,113.8424, Y = 580,092.3499;
4-12           THENCE, S 02 deg. 24' 28" E, along the westerly line of said
4-13     City of Texas City called 375.75 Acre Tract, at a distance of
4-14     186.99 feet pass a 5/8-inch iron rod set for reference with
4-15     coordinates of X = 3,310,121.6938 and Y = 579,905.5280, and
4-16     continuing for a total distance of 2,104.34 feet to a point for
4-17     corner, from which a 5/8-inch iron rod set for reference bears S 02
4-18     deg.  24' 28" E, a distance of 402.98 feet (said 5/8-inch iron rod
4-19     having coordinates of X = 3,310,219.1737 and Y = 577,587.2396);
4-20           THENCE, S 87 deg. 35' 32" W, along a northerly line of said
4-21     City of Texas City called 375.75 Acre Tract, for a distance of
4-22     1,539.99 feet to a point for corner, same being the most westerly
4-23     Northwest corner of said City of Texas City called 375.75 Acre
4-24     Tract;
4-25           THENCE, N 04 deg. 26' 32" E, for a distance of 944.90 feet to
4-26     a point for corner, on the southerly line of the aforesaid
4-27     Industrial Canal as shown on COE Location Map (File 308-) dated
 5-1     June, 1978;
 5-2           THENCE in a generally NORTHEASTERLY direction along the
 5-3     southerly line of said Industrial Canal (called 650 feet wide at
 5-4     this point) as shown on COE Location Map (File 308-) dated June,
 5-5     1978, being a curve to the left having a radius of 2,325.00 feet
 5-6     and a central angle of 36 deg. 00' 55", for an arc distance of
 5-7     1,461.46 feet to an angle point;
 5-8           THENCE, N 55 deg. 02' 36" E, continuing along the southerly
 5-9     line of said Industrial Canal (variable width), for a distance of
5-10     409.21 feet to the POINT OF BEGINNING, of a tract containing 49.55
5-11     acres.
5-12           SECTION 2.  The importance of this legislation and the
5-13     crowded condition of the calendars in both houses create an
5-14     emergency and an imperative public necessity that the
5-15     constitutional rule requiring bills to be read on three several
5-16     days in each house be suspended, and this rule is hereby suspended,
5-17     and that this Act take effect and be in force from and after its
5-18     passage, and it is so enacted.
