A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to membership in the Texas Property and Casualty Insurance
1-3 Guaranty Association; and declaring an emergency.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Amend Article 21.28-C, Section 5(10), Insurance
1-6 Code, to read as follows:
1-7 (10) "Member insurer" means any insurer [person] who:
1-8 (A) writes any kind of insurance to which this
1-9 Act applies under Section 3 of the Act, including the exchange of
1-10 reciprocal or inter-insurance contracts; and
1-11 (B) is licensed to transact insurance in this
1-12 state including any stock, mutual, Lloyds insurer, reciprocal or
1-13 inter-insurance exchange, or county mutual insurance company [or
1-14 other insurer licensed to transact insurance in this state].
1-15 SECTION 2. This Act takes effect September 1, 1999.
1-16 SECTION 3. EMERGENCY. The importance of this legislation
1-17 and the crowded condition of the calendars in both houses create an
1-18 emergency and an imperative public necessity that the
1-19 constitutional rule requiring bills to be read on three several
1-20 days in each house be suspended, and this rule is hereby suspended,
1-21 and that this Act take effect and be in force from and after its
2-1 passage, and it is so enacted.
