No. 1831 76R5857 JD-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to contracts for the disclosure of certain accident and 1-3 conviction information by the Department of Public Safety. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter C, Chapter 521, Transportation Code, 1-6 is amended by adding Section 521.0465 to read as follows: 1-7 Sec. 521.0465. CONTRACTS FOR DISCLOSURE OF CERTAIN ACCIDENT 1-8 AND CONVICTION INFORMATION. (a) The department shall enter into 1-9 contracts under which the department provides the other party to 1-10 the contract with information that: 1-11 (1) is authorized to be released under Section 521.045 1-12 or 521.046; and 1-13 (2) relates to traffic law convictions of individuals 1-14 or the occurrences of motor vehicle accidents involving individuals 1-15 during any 30-day period specified by the person entering into the 1-16 contract. 1-17 (b) Subsection (a) applies only if the person is eligible to 1-18 receive the information under Chapter 730. 1-19 (c) A contract entered into under Subsection (a) must 1-20 require the contracting party to: 1-21 (1) submit to the department the individuals' drivers 1-22 license numbers or the individuals' full names and dates of birth; 1-23 and 1-24 (2) pay the department a monthly fee for providing the 2-1 information in an amount equal to the greater of: 2-2 (A) the department's direct cost of providing 2-3 the information; or 2-4 (B) $3,000. 2-5 (d) The department may require a person entering into a 2-6 contract under Subsection (a) to provide the department a certified 2-7 check, cashier's check, or bond issued by a surety company 2-8 authorized to do business in this state in an amount equal to the 2-9 first payment due under the contract to guarantee the person's 2-10 performance under the contract. 2-11 SECTION 2. This Act takes effect September 1, 1999. 2-12 SECTION 3. The importance of this legislation and the 2-13 crowded condition of the calendars in both houses create an 2-14 emergency and an imperative public necessity that the 2-15 constitutional rule requiring bills to be read on three several 2-16 days in each house be suspended, and this rule is hereby suspended.
