A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to authorizing the board of regents of The University of
1-3 Texas System to acquire certain properties for campus expansion and
1-4 other university purposes.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. The board of regents of The University of Texas
1-7 System is authorized to acquire by purchase, exchange, gift, or in
1-8 any other manner, for campus expansion or other university
1-9 purposes, any or all of the following real property located in
1-10 Harris County and not already acquired by the board of regents:
1-11 1. All land in the P. W. Rose Survey, Abstract No. 645, Houston,
1-12 Harris County, Texas, that is bounded by Fannin, Cecil, and Lehall
1-13 Streets and Braeswood Boulevard, including, without limitation, all
1-14 lots within Blocks 1 and 2, University Park Addition, according to
1-15 the map or plat thereof recorded in Volume 450, Page 564 of the
1-16 Deed Records of Harris County, Texas, and all adjacent strips,
1-17 gores, streets, alleys, alleyways, thoroughfares, and real
1-18 property, whether or not vacated, specifically including, but not
1-19 limited to, Lyndon, Lehall, and Cecil Streets, SAVE AND EXCEPT all
1-20 such real property previously acquired by the Board of Regents and
1-21 SAVE AND EXCEPT Lots 1 through 6, inclusive, and Lots 27 and 28 in
1-22 Block 2, University Park Addition.
1-23 2. All of Blocks 16, 17, 19, 20, 21 and 22, Institute Addition,
1-24 according to the map or plat thereof recorded in Volume 3, Page 5
2-1 of the Map Records of Harris County, Texas, and all adjacent
2-2 strips, gores, streets, alleys, alleyways, thoroughfares, and real
2-3 property, whether or not vacated, specifically including, but not
2-4 limited to, Cecil, Selma, St. Agnes, Eaton and Princeton Streets
2-5 and Braeswood Boulevard, SAVE AND EXCEPT all such real property
2-6 previously acquired by the Board of Regents.
2-7 3. Approximately 1.0447 acres, or 45,505 square feet, more or
2-8 less, of land in the P. W. Rose Survey, Abstract No. 645, Houston,
2-9 Harris County, Texas, said tract being more particularly described
2-10 by metes and bounds in the Warranty Deed dated effective June 26,
2-11 1987, recorded in the Real Property Records of Harris County,
2-12 Texas, under Clerk's File No. L195838, together with all adjacent
2-13 strips or gores of real estate.
2-14 4. Approximately 39,540 square feet out of the P. W. Rose Survey,
2-15 Abstract No. 645, Houston, Harris County, Texas, said tract being
2-16 more particularly described by metes and bounds in the Special
2-17 Warranty Deed dated May 22, 1987, recorded in the Real Property
2-18 Records of Harris County, Texas, under Clerk's File No. L184468,
2-19 together with all adjacent strips or gores of real estate, and
2-20 together with any right, title and interest in the land lying
2-21 between the above described 39,540 square foot tract of land and
2-22 the center line of Wyndale Drive.
2-23 5. All of the land that is bounded on the south by Braeswood
2-24 Boulevard, on the west by the property described in the deed to
2-25 Homegate Hospitality, Inc., recorded in S376020 of the Deed Records
2-26 of Harris County, Texas, and on the east by the property described
2-27 in the deed to the Board of Regents recorded in M54663 of the Deed
3-1 Records of Harris County, Texas, "including, without limitation," a
3-2 0.3940 acre (17,162 square feet) parcel, more or less, out of a
3-3 called 9.19 acre tract as conveyed in deed recorded under Harris
3-4 County Clerk's File No. P626553, said 0.3940 acre tract being out
3-5 of the P.W. Rose Survey, Abstract No. 645, in the City of Houston,
3-6 Harris County, Texas, and being more particularly described by
3-7 metes and bounds as follows with all bearings referenced to the
3-8 recorded plat of M. Sanders as recorded in Volume 340 at Page 103
3-9 of the Harris County Map Records;
3-10 BEGINNING at a 5/8-inch iron rod set in the northerly
3-11 right-of-way line of South Braeswood Boulevard (based on a width of
3-12 120 feet) as described in instrument recorded in Volume 4414 at
3-13 Page 107 of the Harris County Deed Records, same point being in the
3-14 centerline of an abandoned 60-foot right-of-way formerly known as
3-15 Cecil Street, the southwest corner of a tract of land conveyed to
3-16 The University of Texas M.D. Anderson Cancer Center by instrument
3-17 recorded under Harris County Clerk's File No. M546653 and the
3-18 southeast corner of the herein described tract;
3-19 THENCE, S78 35' 21" W, along said northerly right-of-way line
3-20 of South Braeswood Boulevard, a distance of 94.73 feet to a
3-21 5/8-inch iron rod set for the southwest corner of the herein
3-22 described tract;
3-23 THENCE, N 00 50' 34" W, along the westerly line of the herein
3-24 described tract, a distance of 189.90 feet to a 5/8-inch iron rod
3-25 set for the northwest corner of the herein described tract in the
3-26 southerly line of a Harris County Flood Control District
3-27 right-of-way for Brays Bayou as described in instrument recorded in
4-1 Volume 3488 at Page 56 of the Harris County Deed Records;
4-2 THENCE, N 85 22' 57" E, along said southerly right-of-way
4-3 line of Brays Bayou, a distance of 93.33 feet to a 5/8-inch iron
4-4 rod set for the northeast corner of the herein described tract and
4-5 the northwest corner of said tract conveyed to The University of
4-6 Texas M.D. Anderson Cancer Center in the centerline of said
4-7 abandoned 60-foot right-of-way formerly known as Cecil Street;
4-8 THENCE, S 00 50' 34" E, along the easterly line of the herein
4-9 described tract, the westerly line of said tract conveyed to The
4-10 University of Texas M.D. Anderson Cancer Center and the centerline
4-11 of said abandoned 60-foot right-of-way, a distance of 178.67 feet
4-12 to the POINT OF BEGINNING and containing 0.3940 of an acre of land.
4-13 SECTION 2. If all or any portion of the property described
4-14 by this section that is currently owned by the United States is
4-15 made available by the United States by auction, by negotiated sale,
4-16 as surplus property, or in any other manner, the board of regents
4-17 of The University of Texas System is authorized to acquire that
4-18 property by purchase, exchange, gift, or in any other manner, for
4-19 campus expansion or other university purposes. This section
4-20 applies to the following property:
4-21 All property located south of Old Spanish Trail, north of El Paseo
4-22 Street, west of Cambridge Street and east of Fannin Street in
4-23 Houston, Harris County, Texas, that is now owned by the United
4-24 States of America and that is more particularly described as:
4-25 A tract of land containing 790,951.44 square feet (18.1578 acres)
4-26 of land situated in Harris County, Texas.
4-27 Commencing at a Highway Department right of way monument at the
5-1 southeast corner of Knight Road and U.S. Highway 59 (Old Spanish
5-2 Trail).
5-3 THENCE WITH THE SOUTHERN LINE OF SAID HIGHWAY AND IN A COURSE NORTH
5-4 7436' EAST A DISTANCE OF 821.06 FEET TO A POINT OF BEGINNING;
5-5 THENCE NORTH 74 DEG. 28 MIN. 47 SEC. EAST A DISTANCE OF 592.49 FEET
5-6 TO A POINT FOR CORNER;
5-7 THENCE NORTH 74 DEG. 41 MIN. 57 SEC. EAST A DISTANCE OF 720.06 FEET
5-8 TO A 5/8 INCH IRON ROD FOUND FOR CORNER;
5-9 THENCE SOUTH 15 DEC. 16 MIN. 58 SEC. EAST A DISTANCE OF 603.88 FEET
5-10 TO A 1/2 INCH IRON ROD FOUND FOR CORNER;
5-11 THENCE SOUTH 74 DEG. 36 MIN. 13 SEC. WEST A DISTANCE OF 719.87 FEET
5-12 TO A 5/8 INCH IRON ROD FOUND FOR CORNER;
5-13 THENCE NORTH 15 DEG. 46 MIN. 43 SEC. WEST A DISTANCE OF 3.94 FEET
5-14 TO A 5/8 INCH IRON ROD FOUND FOR CORNER;
5-15 THENCE SOUTH 74 DEG. 44 MIN. 27 SEC. WEST A DISTANCE OF 592.27 FEET
5-16 TO A 5/8 INCH IRON ROD SET FOR CORNER;
5-17 THENCE NORTH 24 DEG. 00 MIN. 00 SEC. WEST A DISTANCE OF 600.00 FEET
5-18 TO THE PLACE OF BEGINNING AND CONTAINING 790,951.44 SQUARE FEET
5-19 (18.1578 ACRES), MORE OR LESS, together with all adjacent strips or
5-20 gores of real estate.
5-21 SECTION 3. The importance of this legislation and the
5-22 crowded condition of the calendars in both houses create an
5-23 emergency and an imperative public necessity that the
5-24 constitutional rule requiring bills to be read on three several
5-25 days in each house be suspended, and this rule is hereby suspended,
5-26 and that this Act take effect and be in force from and after its
5-27 passage, and it is so enacted.
