                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to clarifying the judicial immunity applicable to a person
 1-3     who is appointed by a court to serve as trustee of a convalescent
 1-4     or nursing home, an intermediate care facility for the mentally
 1-5     retarded, or a personal care facility.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1.  Section 242.094, Health and Safety Code, is
 1-8     amended by adding Subsection (f) to read as follows:
 1-9           (f)  A trustee appointed under this section has judicial
1-10     immunity for all acts performed or not performed within the scope
1-11     of the authority either given to the trustee by the appointing
1-12     court or approved by the appointing court.
1-13           SECTION 2.  Section 252.093, Health and Safety Code, is
1-14     amended by adding Subsection (f) to read as follows:
1-15           (f)  A trustee appointed under this section has judicial
1-16     immunity for  all acts performed or not performed within the scope
1-17     of the authority either given to the trustee by the appointing
1-18     court or approved by the appointing court.
1-19           SECTION 3.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended,
1-24     and that this Act take effect and be in force from and after its
 2-1     passage, and it is so enacted.
