                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the pooling of turnpike projects by the Texas Turnpike
 1-3     Authority Division of the Texas Department of Transportation.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 361.331, Transportation Code, is amended
 1-6     to read as follows:
 1-7           Sec. 361.331.  Pooled Turnpike Projects.  (a)  After
 1-8     conducting a public hearing in each affected county and obtaining
 1-9     the approval of the commission, the [The] authority may designate
1-10     as a pooled turnpike project two or more turnpike projects that are
1-11     wholly or partly located within the boundaries of:
1-12                 (1)  [in] a metropolitan planning organization; or
1-13                 (2)  two adjacent department districts [as a pooled
1-14     turnpike project after:]
1-15                 [(1)  conducting a public hearing in each affected
1-16     county; and]
1-17                 [(2)  obtaining the approval of the commission].
1-18           (b)  All or parts of one or more existing turnpike projects
1-19     may be pooled with all or part of one or more new turnpike
1-20     projects.
1-21           (c)  Turnpike projects designated as a pooled project are a
 2-1     single turnpike project for purposes of this chapter.
 2-2           [(d)  A turnpike project may not be pooled more than once.]
 2-3           SECTION 2.  The importance of this legislation and the
 2-4     crowded condition of the calendars in both houses create an
 2-5     emergency and an imperative public necessity that the
 2-6     constitutional rule requiring bills to be read on three several
 2-7     days in each house be suspended, and this rule is hereby suspended,
 2-8     and that this Act take effect and be in force from and after its
 2-9     passage, and it is so enacted.
