 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to a report on performance of certain public
 1-9     transportation providers.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Sections 456.008(a) and (b), Transportation Code,
1-12     are amended to read as follows:
1-13           (a)  The commission by rule shall prepare and issue a report
1-14     on the performance of public transportation providers in this state
1-15     that received state or federal funding during the previous 12-month
1-16     period.  The commission shall issue a report under this section at
1-17     least once each  state fiscal year.
1-18           (b)  The commission shall establish a performance-based
1-19     reporting system for all public transportation providers.  The
1-20     commission may establish different performance measures for
1-21     different sectors of the transit industry.  The performance
1-22     measures shall assess the efficiency, effectiveness, and safety of
1-23     the public transportation providers. [A report must include for
1-24     each provider an examination of the following performance
1-25     indicators, as defined by the commission:]
1-26                 [(1)  operating cost per passenger and per revenue
1-27     mile;]
1-28                 [(2)  fare recovery rate;]
1-29                 [(3)  average vehicle occupancy;]
1-30                 [(4)  on-time performance;]
1-31                 [(5)  number of accidents per 100,000 vehicle miles;
1-32     and]
1-33                 [(6)  number of total miles between mechanical road
1-34     calls.]
1-35           SECTION 2.  This Act takes effect September 1, 1999.
1-36           SECTION 3.  The importance of this legislation and the
1-37     crowded condition of the calendars in both houses create an
1-38     emergency and an imperative public necessity that the
1-39     constitutional rule requiring bills to be read on three several
1-40     days in each house be suspended, and this rule is hereby suspended.
