No. 1996 76R7127 PAM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transfer of certain state property from the General 1-3 Services Commission to Bethel African Methodist Episcopal Church. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. (a) The General Services Commission shall 1-6 transfer to Bethel African Methodist Episcopal Church, in San 1-7 Antonio, the real property described by Subsection (d) of this 1-8 section for consideration described by Subsection (b) of this 1-9 section. 1-10 (b) Consideration for the transfer authorized by Subsection 1-11 (a) of this section shall be in the form of an agreement between 1-12 the parties that requires Bethel African Methodist Episcopal Church 1-13 to use the property for a purpose that benefits the public interest 1-14 of the state. Under the terms of the agreement described by this 1-15 subsection: 1-16 (1) Bethel African Methodist Episcopal Church may use 1-17 the property transferred under this Act only for a purpose that 1-18 benefits the public interest of the state; and 1-19 (2) ownership of the property automatically reverts to 1-20 the General Services Commission if Bethel African Methodist 1-21 Episcopal Church no longer uses the property for a purpose that 1-22 benefits the public interest of the state. 1-23 (c) The General Services Commission shall transfer the 1-24 property by an appropriate instrument of transfer. The instrument 2-1 of transfer must include a provision that: 2-2 (1) requires Bethel African Methodist Episcopal Church 2-3 to use the property for a purpose that benefits the public interest 2-4 of the state; and 2-5 (2) indicates that ownership of the property 2-6 automatically reverts to the General Services Commission if Bethel 2-7 African Methodist Episcopal Church no longer uses the property for 2-8 a purpose that benefits the public interest of the state. 2-9 (d) The real property to which Subsection (a) of this 2-10 section refers is described as follows: 2-11 Lot 1 and the West 25 feet of Lot 2, Block 9, New City Block 582, 2-12 in the City of San Antonio, Bexar County, Texas. 2-13 SECTION 2. The importance of this legislation and the 2-14 crowded condition of the calendars in both houses create an 2-15 emergency and an imperative public necessity that the 2-16 constitutional rule requiring bills to be read on three several 2-17 days in each house be suspended, and this rule is hereby suspended, 2-18 and that this Act take effect and be in force from and after its 2-19 passage, and it is so enacted.
