1-1 AN ACT
1-2 relating to surrender of a suspended or revoked driver's license or
1-3 vehicle registration.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 521.308, Transportation Code, is amended
1-6 to read as follows:
1-7 Sec. 521.308. SURRENDER OF LICENSE; RETURN. (a) On the
1-8 suspension or revocation of a license by the department, the
1-9 department may [shall] require the holder to surrender the license
1-10 to the department.
1-11 (b) The department may [shall] return a suspended license to
1-12 the holder on the expiration of the suspension period.
1-13 SECTION 2. Section 521.347(a), Transportation Code, is
1-14 amended to read as follows:
1-15 (a) The court in which a person is convicted of an offense
1-16 for which this chapter or Chapter 522 requires automatic suspension
1-17 of the person's driver's license may [shall] require the person to
1-18 surrender to the court each driver's license held by the person.
1-19 Not later than the 10th day after the date on which the license is
1-20 surrendered to the court, the clerk of the court shall send to the
1-21 department:
1-22 (1) the license; and
1-23 (2) a record of the conviction that states whether the
1-24 vehicle involved in the offense was a commercial motor vehicle as
2-1 defined by Chapter 522 or was involved in the transport of
2-2 hazardous materials.
2-3 SECTION 3. Section 601.372(c), Transportation Code, is
2-4 amended to read as follows:
2-5 (c) The department by rule may require the person to [shall]
2-6 send the person's driver's license and vehicle registrations not
2-7 later than the 10th day after the date the person receives written
2-8 notice from the department.
2-9 SECTION 4. Section 601.373(b), Transportation Code, is
2-10 amended to read as follows:
2-11 (b) The department may [shall] direct a department employee
2-12 to obtain and send to the department the driver's license and
2-13 vehicle registration of a person who fails to send the person's
2-14 license or registration in accordance with Section 601.372. The
2-15 director of the department or the person designated by the
2-16 director may file a complaint against a person for an offense under
2-17 Subsection (a).
2-18 SECTION 5. This Act takes effect September 1, 1999.
2-19 SECTION 6. The importance of this legislation and the
2-20 crowded condition of the calendars in both houses create an
2-21 emergency and an imperative public necessity that the
2-22 constitutional rule requiring bills to be read on three several
2-23 days in each house be suspended, and this rule is hereby suspended.
