A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to a disqualification for receipt of unemployment
1-3 compensation benefits for a benefit period in which the applicant
1-4 for benefits works at least 40 hours.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 201.091, Labor Code, is amended by adding
1-7 Subsection (e) to read as follows:
1-8 (e) For purposes of this subtitle, an individual is not
1-9 considered unemployed and is not eligible to receive benefits for
1-10 any benefit period in which the individual works at least 40
1-11 hours, regardless of the amount of wages the individual earns
1-12 during the benefit period.
1-13 SECTION 2. This Act takes effect September 1, 1999, and
1-14 applies only to a claim for unemployment compensation benefits that
1-15 is filed with the Texas Workforce Commission on or after that date.
1-16 A claim filed before that date is governed by the law in effect on
1-17 the date that the claim was filed, and the former law is continued
1-18 in effect for that purpose.
1-19 SECTION 3. The importance of this legislation and the
1-20 crowded condition of the calendars in both houses create an
1-21 emergency and an imperative public necessity that the
1-22 constitutional rule requiring bills to be read on three several
1-23 days in each house be suspended, and this rule is hereby suspended.
