No. 2151 76R7831 AJA-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to immunity from liability of a member of the board of 1-3 directors of a public facility corporation. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 3.028, Public Facility Corporation Act 1-6 (Article 717s, Vernon's Texas Civil Statutes), is amended by adding 1-7 Subsection (g) to read as follows: 1-8 (g) A member of a corporation's board of directors is 1-9 granted the same immunity from liability as is granted under the 1-10 laws of this state to a member of the governing body of the 1-11 sponsor of the corporation. 1-12 SECTION 2. This Act takes effect September 1, 1999, and 1-13 applies only to a cause of action that accrues on or after that 1-14 date. A cause of action that accrues before the effective date of 1-15 this Act is governed by the law as it existed immediately before 1-16 the effective date of this Act, and that law is continued in effect 1-17 for that purpose. 1-18 SECTION 3. The importance of this legislation and the 1-19 crowded condition of the calendars in both houses create an 1-20 emergency and an imperative public necessity that the 1-21 constitutional rule requiring bills to be read on three several 1-22 days in each house be suspended, and this rule is hereby suspended. 1-23 COMMITTEE AMENDMENT NO. 1 1-24 Amend H.B. 2151, SECTION 1, by striking new Subsection (g) of 2-1 Section 3.028, and replacing it with a new (g) to read as follows: 2-2 (g) A member of a corporation's board of directors is 2-3 granted the same immunity from liability as is granted under the 2-4 laws of this state to a member of the governing body of the sponsor 2-5 of the corporation if the director was acting in good faith and in 2-6 the course and scope of the duties or functions within the 2-7 corporation. 2-8 Bosse
