                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a partial lump-sum distribution on retirement from the
 1-3     Texas County and District Retirement System.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter A, Chapter 844, Government Code, is
 1-6     amended by adding Section 844.009 to read as follows:
 1-7           Sec. 844.009.  PARTIAL LUMP-SUM DISTRIBUTION ON RETIREMENT.
 1-8     (a)  A member who is eligible for service retirement and who
 1-9     terminates employment with all participating subdivisions may apply
1-10     for a partial lump-sum distribution under this section.
1-11           (b)  The amount of a lump-sum distribution under this section
1-12     may not exceed one-half of the total contributions and accumulated
1-13     interest in the member's individual account in the employees saving
1-14     fund at the time of the member's retirement.
1-15           (c)  The lump-sum distribution will be made as a single
1-16     payment, payable at the same time as the first monthly annuity
1-17     payment that is paid to  the member.
1-18           (d)  The amount of the lump-sum distribution will be deducted
1-19     from the sum used in computing the member's current service annuity
1-20     under Section 844.002.  If a payment is made under Section 844.402,
1-21     the amount of the lump-sum distribution will be considered to be
1-22     included in the payments made by reason of the annuity.
1-23           SECTION 2.  This Act takes effect September 1, 1999.
1-24           SECTION 3.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended.
