                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the certification of municipal police officers to
 1-3     enforce commercial motor vehicle safety standards.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 644.101(b), Transportation Code, is
 1-6     amended to read as follows:
 1-7           (b)  A police officer of any of the following municipalities
 1-8     is eligible to apply for certification under this section:
 1-9                 (1)  a municipality with a population of 100,000 or
1-10     more;
1-11                 (2)  a municipality with a population of 25,000 or more
1-12     any part of which is located in a county with a population of 2.4
1-13     million or more; [or]
1-14                 (3)  a municipality with a population of less than
1-15     25,000:
1-16                       (A)  any part of which is located in a county
1-17     with a population of 2.4 million; and
1-18                       (B)  that contains or is adjacent to an
1-19     international port; or
1-20                 (4)  a municipality any part of which is located in a
1-21     county bordering the United Mexican States.
1-22           SECTION 2.  (a)  In accordance with Section 311.031(c),
1-23     Government Code, which gives effect to a substantive amendment
1-24     enacted by the same legislature that codifies the amended statute,
 2-1     the text of Section 644.001(b), Transportation Code, as set out in
 2-2     this Act, gives effect to changes made by Chapters 364 and 1061,
 2-3     Acts of the 75th Legislature, Regular Session, 1997.
 2-4           (b)  To the extent of any conflict, this Act prevails over
 2-5     another Act of the 76th Legislature, Regular Session, 1999,
 2-6     relating to nonsubstantive additions and corrections in enacted
 2-7     codes.
 2-8           SECTION 3.  The importance of this legislation and the
 2-9     crowded condition of the calendars in both houses create an
2-10     emergency and an imperative public necessity that the
2-11     constitutional rule requiring bills to be read on three several
2-12     days in each house be suspended, and this rule is hereby suspended,
2-13     and that this Act take effect and be in force from and after its
2-14     passage, and it is so enacted.
