No. 2219 1-2 (In the Senate - Received from the House April 26, 1999; 1-3 April 27, 1999, read first time and referred to Committee on State 1-4 Affairs; May 14, 1999, reported favorably by the following vote: 1-5 Yeas 8, Nays 0; May 14, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to an exemption from investment training for officers and 1-9 employees of emergency services and rural fire prevention 1-10 districts. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter C, Chapter 775, Health and Safety 1-13 Code, is amended by adding Section 775.041 to read as follows: 1-14 Sec. 775.041. EXEMPTION FROM INVESTMENT TRAINING. (a) 1-15 Section 2256.008, Government Code, does not apply to an officer or 1-16 employee of a district created under this chapter. 1-17 (b) A district may invest funds only in the authorized 1-18 investments set forth under Government Code Section 2256.009 1-19 (obligations of, or guaranteed by governmental entities), 2256.010 1-20 (certificates of deposit and share certificates), or 2256.016 1-21 (investment pools), unless the treasurer, chief financial officer 1-22 (if not the treasurer), and the investment officer of the district 1-23 attend and successfully complete the training requirements under 1-24 Section 2256.008, Government Code. 1-25 SECTION 2. Subchapter C, Chapter 794, Health and Safety 1-26 Code, is amended by adding Section 794.038 to read as follows: 1-27 Sec. 794.038. EXEMPTION FROM INVESTMENT TRAINING. (a) 1-28 Section 2256.008, Government Code, does not apply to an officer or 1-29 employee of a district created under this chapter. 1-30 (b) A district may invest funds only in the authorized 1-31 investments set forth under Government Code Section 2256.009 1-32 (obligations of, or guaranteed by governmental entities), 2256.010 1-33 (certificates of deposit and share certificates), or 2256.016 1-34 (investment pools), unless the treasurer, chief financial officer 1-35 (if not the treasurer), and the investment officer of the district 1-36 attend and successfully complete the training requirements under 1-37 Section 2256.008, Government Code. 1-38 SECTION 3. The importance of this legislation and the 1-39 crowded condition of the calendars in both houses create an 1-40 emergency and an imperative public necessity that the 1-41 constitutional rule requiring bills to be read on three several 1-42 days in each house be suspended, and this rule is hereby suspended, 1-43 and that this Act take effect and be in force from and after its 1-44 passage, and it is so enacted. 1-45 * * * * *
