A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the renewal of a person's license to carry a concealed
1-3 handgun and to the procedures for that renewal.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 411.183(b), Government Code, is amended
1-6 to read as follows:
1-7 (b) A renewed license expires on the license holder's
1-8 birthdate, five [four] years after the date of the expiration of
1-9 the previous license.
1-10 SECTION 2. Section 411.185, Government Code, is amended by
1-11 amending Subsection (a) and adding Subsections (e) and (f) to read
1-12 as follows:
1-13 (a) To renew a license, a license holder must:
1-14 (1) complete a continuing education course in handgun
1-15 proficiency under Section 411.188(c) not more than six months
1-16 before the date of application for renewal;
1-17 (2) obtain a handgun proficiency certificate under
1-18 Section 411.189 not more than six months before the date of
1-19 application for renewal; and
1-20 (3) submit to the department:
1-21 (A) an application for renewal on a form
1-22 provided by the department;
1-23 (B) a copy of the handgun proficiency
1-24 certificate;
2-1 (C) payment of a nonrefundable renewal fee as
2-2 set by the department; and
2-3 (D) two recent color passport photographs of the
2-4 applicant, except as provided by Subsection (e).
2-5 (e) The director shall establish a procedure by which a
2-6 person may renew the person's license to carry a concealed handgun
2-7 by reporting in person to the location designated by the department
2-8 as the location for a person to obtain an original driver's license
2-9 issued by the department. An applicant for renewal of a license to
2-10 carry a concealed handgun under this subsection must comply with
2-11 each requirement of Subsection (a), except that an applicant who at
2-12 the time of renewing a license under this subsection submits to the
2-13 taking of a driver's license photograph is not required to submit a
2-14 passport photograph to the department.
2-15 (f) A license holder is not required to sign the application
2-16 form described by Subsection (a)(3)(A) before a notary public or
2-17 other official authorized to administer oaths.
2-18 SECTION 3. (a) The change in law made by this Act to
2-19 Section 411.183(b), Government Code, applies only to a license
2-20 renewed on or after September 1, 1999.
2-21 (b) The director of the Department of Public Safety shall
2-22 establish the procedure required by Section 411.185(e), Government
2-23 Code, as added by this Act, not later than January 1, 2000.
2-24 SECTION 4. The importance of this legislation and the
2-25 crowded condition of the calendars in both houses create an
2-26 emergency and an imperative public necessity that the
2-27 constitutional rule requiring bills to be read on three several
3-1 days in each house be suspended, and this rule is hereby suspended,
3-2 and that this Act take effect and be in force from and after its
3-3 passage, and it is so enacted.
