A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to establishing a procedure for a person to renew the
1-3 person's driver's license and the person's license to carry a
1-4 concealed handgun at the same time.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Sections 411.183(a) and (b), Government Code, are
1-7 amended to read as follows:
1-8 (a) A license issued under this subchapter expires on the
1-9 first birthday of the license holder occurring after the sixth
1-10 [fourth] anniversary of the date of issuance.
1-11 (b) A renewed license expires on the license holder's
1-12 birthdate, six [four] years after the date of the expiration of the
1-13 previous license.
1-14 SECTION 2. Section 411.185, Government Code, is amended by
1-15 amending Subsection (a) and adding Subsection (e) to read as
1-16 follows:
1-17 (a) To renew a license, a license holder must:
1-18 (1) complete a continuing education course in handgun
1-19 proficiency under Section 411.188(c) not more than six months
1-20 before the date of application for renewal;
1-21 (2) obtain a handgun proficiency certificate under
1-22 Section 411.189 not more than six months before the date of
1-23 application for renewal; and
1-24 (3) submit to the department:
2-1 (A) an application for renewal on a form
2-2 provided by the department;
2-3 (B) a copy of the handgun proficiency
2-4 certificate;
2-5 (C) payment of a nonrefundable renewal fee as
2-6 set by the department; and
2-7 (D) two recent color passport photographs of the
2-8 applicant, except as provided by Subsection (e).
2-9 (e) The director shall establish a procedure by which a
2-10 person who holds a driver's license and a license to carry a
2-11 concealed handgun that expire on the same date may renew both
2-12 licenses on one occasion by reporting in person to a designated
2-13 location. An applicant for renewal of a license to carry a
2-14 concealed handgun under this subsection must comply with each
2-15 requirement of Subsection (a), except that the applicant is not
2-16 required to submit a passport photograph to the department.
2-17 SECTION 3. Subchapter M, Chapter 521, Transportation Code,
2-18 is amended by adding Section 521.272 to read as follows:
2-19 Sec. 521.272. VOLUNTARY SURRENDER. (a) Notwithstanding
2-20 Section 521.271, a person who is otherwise eligible to renew the
2-21 person's driver's license may voluntarily surrender the license
2-22 before the expiration date of the license and apply for the
2-23 issuance of a new license that expires on the expiration date of
2-24 the person's license to carry a concealed handgun under the
2-25 authority of Subchapter H, Chapter 411, Government Code.
2-26 (b) The department shall establish a standard application
2-27 form to be used by a person who applies for a license under this
3-1 section. The department may charge the person a fee in an amount
3-2 equal to the amount of the fee for issuance or renewal of a license
3-3 under Section 521.421.
3-4 SECTION 4. Subchapter E, Chapter 522, Transportation Code,
3-5 is amended by adding Section 522.054 to read as follows:
3-6 Sec. 522.054. VOLUNTARY SURRENDER. (a) Notwithstanding any
3-7 other provision of this subchapter, a person who is otherwise
3-8 eligible to renew the person's commercial driver's license may
3-9 voluntarily surrender the license before the expiration date of
3-10 the license and apply for the issuance of a new license that
3-11 expires on the expiration date of the person's license to carry a
3-12 concealed handgun under the authority of Subchapter H, Chapter 411,
3-13 Government Code.
3-14 (b) The department shall establish a standard application
3-15 form to be used by a person who applies for a license under this
3-16 section. The department may charge the person a fee in an amount
3-17 equal to the amount of the fee for issuance or renewal of a license
3-18 under Section 521.421.
3-19 SECTION 5. (a) The change in law made by this Act to
3-20 Sections 411.183(a) and (b), Government Code, applies only to a
3-21 license issued or renewed on or after September 1, 1999.
3-22 (b) The director of the Department of Public Safety shall
3-23 establish the procedure required by Section 411.185(e), Government
3-24 Code, as added by this Act, not later than January 1, 2000.
3-25 (c) The Department of Public Safety shall establish the
3-26 standard application forms required by Sections 521.272 and
3-27 522.054, Transportation Code, as added by this Act, not later than
4-1 January 1, 2000.
4-2 SECTION 6. The importance of this legislation and the
4-3 crowded condition of the calendars in both houses create an
4-4 emergency and an imperative public necessity that the
4-5 constitutional rule requiring bills to be read on three several
4-6 days in each house be suspended, and this rule is hereby suspended,
4-7 and that this Act take effect and be in force from and after its
4-8 passage, and it is so enacted.
