                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the composition of certain sheriff's department civil
 1-3     service panels.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 158.035(c), Local Government Code, is
 1-6     amended to read as follows:
 1-7           (c)  In a county with a population of 2.8 million or more, a
 1-8     panel of three commissioners shall preside at the hearing and vote
 1-9     on the commission's final decision in any case involving
1-10     termination, demotion, or recovery of back pay.  A panel's decision
1-11     is the final decision of the commission for purposes of Sections
1-12     158.0351 and 158.037.  The commission shall adopt rules prescribing
1-13     the commission's procedures for assigning members to a panel.  [A
1-14     panel may not include more than one member who was appointed to the
1-15     commission by the same individual appointing authority.]
1-16           SECTION 2.  This Act takes effect September 1, 1999.
1-17           SECTION 3.  The importance of this legislation and the
1-18     crowded condition of the calendars in both houses create an
1-19     emergency and an imperative public necessity that the
1-20     constitutional rule requiring bills to be read on three several
1-21     days in each house be suspended, and this rule is hereby suspended.
