 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to advisory committees to the Parks and Wildlife
 1-9     Commission.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subchapter B, Chapter 11, Parks and Wildlife
1-12     Code, is amended by adding Section 11.0162 to read as follows:
1-13           Sec. 11.0162.  ADVISORY COMMITTEES TO COMMISSION.  (a)  The
1-14     chairman may appoint committees to advise the commission on issues
1-15     under its jurisdiction.
1-16           (b)  The chairman may adopt rules that set the membership,
1-17     terms of service, qualifications, operating procedures, and other
1-18     standards to ensure the effectiveness of an advisory committee
1-19     appointed under this section.
1-20           SECTION 2.  The following provisions of the Parks and
1-21     Wildlife Code are repealed:
1-22                 (1)  Sections 22.002-22.005;
1-23                 (2)  Sections 22.262-22.264;
1-24                 (3)  Section 28.003;
1-25                 (4)  Section 49.016; and
1-26                 (5)  Section 89.021(d).
1-27           SECTION 3.  Section 22.013, Parks and Wildlife Code, is
1-28     amended to read as follows:
1-29           Sec. 22.013.  MEETINGS.  (a)  The San Jacinto Historical
1-30     Advisory Board shall meet quarterly to review the policies and
1-31     operations of the San Jacinto Battleground and to advise the
1-32     department on the proper historical development of the
1-33     battleground.
1-34           (b)  The board shall prepare minutes for all board meetings
1-35     and deliver them to the commission.  The board shall deliver the
1-36     board's bylaws and any changes made to the bylaws to the
1-37     commission.  Any minutes or bylaws delivered to the commission
1-38     shall be delivered by the member of the board who is an employee of
1-39     the department.
1-40           SECTION 4.  (a)  This Act takes effect September 1, 1999.
1-41           (b)  The term of a member of an advisory committee,
1-42     commission, or board created under Section 22.002, 22.262, 28.003,
1-43     49.016, or 89.021(d), Parks and Wildlife Code, repealed by Section
1-44     2 of this Act, who is serving on August 31, 1999, expires September
1-45     1, 1999.
1-46           (c)  Any bequest, gift, or grant of money or property
1-47     accepted by the Fannin State Park Advisory Commission under Section
1-48     22.004, Parks and Wildlife Code, repealed by Section 2 of this Act,
1-49     that is held by the commission on August 31, 1999, is transferred
1-50     on September 1, 1999, to the Parks and Wildlife Department; if a
1-51     grantor of transferred funds or property specified a purpose for
1-52     which the funds or property were to be used, the department shall
1-53     use those funds or property for the specified purpose.
1-54           (d)  The department shall retain all data collected under
1-55     Section 22.005, Parks and Wildlife Code, repealed by Section 2 of
1-56     this Act, and shall use it to depict the story of Texas history and
1-57     independence at the battleground.
1-58           SECTION 5.  The importance of this legislation and the
1-59     crowded condition of the calendars in both houses create an
1-60     emergency and an imperative public necessity that the
1-61     constitutional rule requiring bills to be read on three several
1-62     days in each house be suspended, and this rule is hereby suspended.
