                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to establishment of juvenile curfews in counties and
 1-3     municipalities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter Z, Chapter 341, Local Government Code,
 1-6     is amended by adding Section 341.906 to read as follows:
 1-7           Sec. 341.906.  JUVENILE CURFEW IN HOME-RULE MUNICIPALITY.
 1-8     The governing body of a home-rule municipality may not adopt a
 1-9     curfew to regulate the movements or actions of persons under 17
1-10     years of age during school hours.
1-11           SECTION 2.  Section 351.903(a), Local Government Code, is
1-12     amended to read as follows:
1-13           (a)  To provide for the public safety, the commissioners
1-14     court of a county by order may adopt a curfew to regulate the
1-15     movements or actions of persons under 17 years of age during the
1-16     period beginning one-half hour after sunset and extending until
1-17     one-half hour before sunrise [or during school hours, or both].
1-18     The order applies only to the unincorporated area of the county.
1-19           SECTION 3.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
