                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to fees charged for traffic cases disposed of by driving
 1-3     safety courses.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 543.106, Transportation Code, is amended
 1-6     to read as follows:
 1-7           Sec. 543.106.  Fee for Request.  (a)  The court may require a
 1-8     person requesting a driving safety course pursuant to Section
 1-9     543.103 to pay a fee set by the court at an amount of not more than
1-10     $10, including any other fee authorized by statute or municipal
1-11     ordinance, to cover the cost of administering this subchapter.
1-12           (b)  The court may require a person requesting a driving
1-13     safety course pursuant to Section 543.104 to pay a fee set by the
1-14     court at an amount of not more than $50, including any other fee
1-15     authorized by statute or municipal ordinance, to cover the cost of
1-16     administering this subchapter.
1-17           (c)  A person who requests but does not take a course is not
1-18     entitled to a refund of the fee.
1-19           (d) [(c)]  Fees collected by a municipal court shall be
1-20     deposited in the municipal treasury.  Fees collected by another
1-21     court shall be deposited in the county treasury of the county in
1-22     which the court is located.
1-23           SECTION 2.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
