                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to service retirement benefits for certain members of the
 1-3     Employees Retirement System of Texas who are affected by a
 1-4     workforce reduction.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Sections 814.1041(a) and (f), Government Code,
 1-7     are amended to read as follows:
 1-8           (a)  This section applies only to members of the employee
 1-9     class whose positions with the Texas Workforce Commission[, the
1-10     Texas Department of Human Services, or the Texas Department of
1-11     Mental Health and Mental Retardation] are eliminated as a result of
1-12     contracts with private service providers or other reductions in
1-13     services provided by those agencies and who separate from state
1-14     service at that time.
1-15           (f)  This section applies only to positions eliminated by
1-16     privatization or other reductions in workforce before September 1,
1-17     2001 [1999].
1-18           SECTION 2.  This Act takes effect September 1, 1999.
1-19           SECTION 3.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
