A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to certain promotional activities for certain alcoholic
1-3 beverage permit holders and licensees.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 108.04, Alcoholic Beverage Code, is
1-6 amended to read as follows:
1-7 Sec. 108.04. ACTS OF PROMOTIONAL OR COURTESY NATURE:
1-8 ADMINISTRATIVE DISCRETION. The commission may promulgate rules
1-9 which shall set definite limitations consistent with the general
1-10 provisions of this code, relaxing the restrictions of Sections
1-11 102.07, 102.14, 102.15, and 108.06 [of this code], with respect to:
1-12 (1) the sale or gift of novelties advertising the
1-13 product of a manufacturer or distributor;
1-14 (2) the making of gifts to civic, religious, or
1-15 charitable organizations;
1-16 (3) the cleaning and maintenance of coil connections
1-17 for dispensing draught beer;
1-18 (4) the lending of equipment for special occasions;
1-19 and
1-20 (5) acts of a purely courtesy nature.
1-21 SECTION 2. This Act takes effect September 1, 1999.
1-22 SECTION 3. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
